BY AND ARE BECOMING A PARTY TO THIS AGREEMENT. IF YOU DO
NOT AGREE TO ALL OF THE TERMS IN THIS AGREEMENT, CLICK THE
"No" BUTTON AND THE INSTALLATION WILL TERMINATE.
Introduction
This agreement explains when and how you may use both shareware and
registered copies of software products from Triplebit Software.In this
agreement:
"YOU" means the end user of the software.
"WE" means Triplebit Software.
"PRODUCT" or "SOFTWARE" means the software Virtual Personality+, YOU have
purchased or obtained electronically or by any other means.This includes all
the source files exectutables and libraries that may or may not have come
with the PRODUCT.
License Grant
Triplebit grants YOU to use only one copy of the SOFTWARE.
It means that YOU are allowed to download, store, install and
execute the SOFTWARE on a single computer.
Ownership and Copyright
The SOFTWARE is owned and copyrighted by Triplebit or its third
party suppliers. This license confers no title to, or ownership in the
SOFTWARE to YOU. The SOFTWARE is protected by United States copyright laws
and international treaty provisions. YOU may not remove the copyright
notice from any copy or component of the PRODUCT.
Copies
YOU may copy the SOFTWARE for archival purposes only.YOU may not copy
the SOFTWARE to any public network.
Transfer, rent, lease, lend, distribute and sublicense
YOU may not transfer or rent or lease or lend or distribute or
sublicense the PRODUCT in whole or in part, to any other party.
Reverse Engineering Decompilation and Disassembly
YOU may not reverse engineer, decompile, disassemble or otherwise reduce the
SOFTWARE to a human-preceivable form.
Modification and Adaptation
YOU may not modify, adapt or create derivative works based on the SOFTWARE.
YOU may not seperate the component parts for use on more than one computer.
Export
YOU may not export or re-export the SOFTWARE to any country,personality
or end user in violation of any applicable U.S.A laws or regulations.
Termination
Triplebit may terminate your license upon notice for failure to comply
with any of these License terms. YOU also may terminate this license at
any time. In either case, YOU must immediatly destroy the SOFTWARE,
together with all copies and components.
Software Piracy
WE will take legal action against any users that are found to be pirating
our PRODUCT.In addition, WE shall report any users found pirating other
products to the products developer or care-keeper.
Limited warranties and liability
a.
The PRODUCT is provided on "as is" basis, without any warranties, expressed
or implied, including but not limited to warranties of performance, quality,
merchantability or fitness for a particular purpose,providing support
services, or those arising by law, statute, usage of trade or course of
dealing. The entire risk as to the results and performance of the PRODUCT
is assumed by YOU. Neither WE nor our dealers or suppliers shall have any
liability to YOU or any other personality or entity, for any indirect, incidental,
special or consequential damages whatsoever, including, but not limited to,
loss of revenue or profit, lost or damaged data or other commercial economic
loss. Triplebit is not obligated to provide any updates to the SOFTWARE.
b. (USA only)
Some states do not allow the exclusion of implied warranties,so the above
exclusion may not apply to YOU. This warranty gives YOU legal rights and YOU
may also have other legal rights which vary from state to state.
Limitation of damages
a.
WE shall not be liable for any indirect, special, incidental or consequential
damages(including damages for loss of business, loss of profits, or the like),
whether based on breach of contract, tort(including negligence), PRODUCT
liability or otherwise, even if Triplebit or its representatives have been
advised of the possibility of such damages and even if a remedy set forth
herein is found to have failed of its essential purpose.
b. (USA only)
Some states do not allow the limitation or exclusion or liability for
incidental of consequential damages, so the above exclusion may not apply
to YOU.
Acknoledgment
You acknoledge that you have read this license agreement, understand it,
and agree to be bound by its terms and conditions.
